È stato pubblicato il regolamento contenente disposizioni per l’adeguamento della normativa nazionale alle norme del c.d. GDPR (Regolamento Privacy), in vigore dallo scorso 25 maggio. Il Regolamento non abroga la previgente disciplina in materia di privacy ma la supera laddove introduce nuovi obblighi e adempimenti, rendendosi dunque necessaria una normativa interna di coordinazione e adeguamento.
Ecco le principali novità:
Regole deontologiche nell’ambito dei rapporti di lavoro: il Garante promuove l’adozione di regole deontologiche per i soggetti pubblici e privati interessati al trattamento dei dati personali effettuato nell’ambito del rapporto di lavoro, prevedendo anche delle specifiche modalità per le informazioni da rendere ai soggetti interessati.
PMI: per rispondere alle esigenze di semplificazione delle micro, piccole e medie imprese, si prevede che il Garante per la protezione dei dati personali preveda delle modalità semplificate di adempimento degli obblighi in capo al titolare del trattamento.
Sanzioni e reati: vengono forniti i criteri di applicazione delle sanzioni amministrative pecuniarie nonché la definizione delle pene per i reati relativi all’illecito trattamento dei dati personali, già previsti dal GDPR; vengono inoltre introdotte nuove ipotesi di reato non precedentemente contemplate nella preesistente disciplina in tema privacy.
Si segnala inoltre che, è previsto un periodo transitorio di 8 mesi per l’applicazione delle sanzioni amministrative così come regolamentate dal Decreto di adeguamento, in vigore dal 19 settembre 2018: «Per i primi otto mesi dalla data di entrata in vigore del presente decreto, il Garante per la protezione dei dati personali tiene conto, ai fini dell’applicazione delle sanzioni amministrative e nei limiti in cui risulti compatibile con le disposizioni del Regolamento (UE) 2016/679, della fase di prima applicazione delle disposizioni sanzionatorie».
