Dodici giorni all’anno, non uno di più. Turni a rotazione definiti a livello locale. Stop alla liberalizzazione selvaggia che “non operando alcuna distinzione tra piccoli e grandi esercenti, li pone in condizione di concorrenza diretta e spietata”. E chi vorrà fare shopping online in un festivo, sappia che “l’attività commerciale che si svolge in Italia non sarà esercitata in alcuna delle sue fasi”. Addio negozi sempre aperti e acquisti a Pasqua e Ferragosto. II deputato grillino Davide Crippa, oggi sottosegretario allo Sviluppo economico, ha presentato una proposta di legge per eliminare la liberalizzazione delle aperture dei negozi fissata nel 2011 dal governo Monti con il decreto Salva Italia. La proposta è stata presentata alla Camera il 18 aprile scorso e stabilisce una nuova disciplina sugli orari e i giorni di apertura degli esercizi commerciali. Intanto, per ogni Comune viene previsto un limite del 25% di esercizi commerciali dello stesso settore merceologico aperti la domenica o in un giorno festivo e fissa a 12 giorni il limite massimo di aperture festive all’anno. Sono esclusi però gli esercizi nelle località turistiche. Poi rimanda a Regioni e Comuni la regolazione delle aperture attraverso turni a rotazione. 11 modello, spiega Crippa, è “quello sperimentato con successo a Modena”, dove il Comune nel 2015 ha approvato un Codice comportamentale di autoregolamentazione che prevede la chiusura dei negozi in tutta la città in alcune feste comandate come Natale, Capodanno, 25 Aprile, Primo Maggio, e invece aperture a rotazione solo in alcune zone della città. E ieri il sottosegretario al Lavoro Claudio Cominardi ha ricevuto al ministero i sindacati di base per un tavolo di confronto e ha promesso l’impegno del governo per risolvere al più presto la questione: “Migliaia di lavoratori e commercianti attendono risposte a un problema di grandi proporzioni”. Il punto di partenza, ha detto Cominardi, resta l’originaria proposta di Michele Dell’Orco, deputato 5 Stelle (oggi sottosegretario alle Infrastrutture), che nel 2014 firmò un ddl che obbligava i negozi alla chiusura per almeno 6 festivi all’anno. II disegno di legge fu approvato alla Camera ma non al Senato. Ora la nuova proposta è pronta e Francesco Iacovone, sindacalista Cobas presente al tavolo del ministero, si dice “ottimista: è stata una discussione approfondita, abbiamo parlato di sfruttamento e precarietà e il ministero si è impegnato anche a rivedere il sistema ispettivo”. E i sindacati di categoria di Cgil, Cisl e Uil, da tempo in prima linea contro il lavoro domenicale con la campagna «La Festa non si vende», chiedono un incontro al ministro del Lavoro Luigi Di Maio per «definire una normativa e mettere ordine nel panorama legislativo». E anche Renato Borghi, vicepresidente di Confcommercio, plaude all’iniziativa del governo: “Una regolazione è indispensabile”.
